How do I arrange to have wines delivered?

Can I place orders via the website for delivery?

Are you cheaper than storing with my wine merchant?

If they offer storage, the most cost effective way to store your wine is often with the merchant that you’ve purchased it from as they can subsidise their storage charges against wine sales. However, this will negate the associated benefits and reassurance of truly Independent storage of your wines.


Can I open an account directly with the warehouse?

Yes, however you may find it to be more expensive than a Nexus account and the inventory information provided might be limited. You may also have to arrange your own insurance. Being a NEXUS member gives you the effective negotiating power of over 2000 collectors.


Can I store mixed cases?

Mixed cases can be stored if you’re Nexus Premium account holder. We require mixed cases to be photographed upon arrival. Pricing


Can I store wines in multiple locations?

You can store across any of our designated locations and view your Collection via your online portal. Storage Locations


Can I store spirits?

You can store spirits as a Nexus Premium account holder. Pricing


Will my wines all be stored together?

Not necessarily. Cases are stored to use space cost effectively and keep movement of wine to a minimum. Your cases are all individually identified by a unique rotation number specific to you.


Are my cases labelled individually with my name and a unique reference?

Every case is labelled with your account number and identified by a unique rotation number specific to you.


Which warehouse will suit me best?

All our storage locations offer professional, climate controlled storage conditions. If you purchase the majority of your wine from a specific merchant, it makes sense to store within the same location (if we offer this) or within the same distribution network. This will keep transfer costs from your merchant to your Nexus account to a minimum.


Can I have single bottles delivered?

There is a picking charge of £10 plus VAT per wine to bottle pick. Free of charge for Nexus Premium (restrictions apply). Pricing


Are you insured when you deliver or collect my wines?

Yes, up to £250k as standard. Higher values on request.


What happens if there’s a breakage on my delivery?

Please advise Nexus immediately, annotate the delivery note which accompanies your delivery accordingly and ask the driver to sign to confirm the damage. We will execute all claims to full market replacement cost on your behalf.


What happens if I’m not in when my delivery comes?

If you have provided a contact number, the driver or Nexus will try to contact you. If unsuccessful, the driver will leave a card and delivery will be rescheduled (chargeable).

Do you have your own storage facility?

We have dedicated space within existing professional storage facilities benefitting from the economies of scale with large logistics partners.


Is your warehouse temperature and humidity controlled?

All of our storage locations have climate control to ensure perfect conditions. In some places (above ground) the challenge is temperature, in some places (below ground) the challenge is humidity.


What’s the ideal temperature and humidity to store wine?

12-15 °C and 65-75% humidity.


What’s the difference between Standard & higher Nexus memberships?

Are my wines insured, with whom and how is the value calculated?

Your wines are fully insured as part of your membership at current market value underwritten by Lloyds, a copy of the policy is available upon request. We receive market valuations via a live data feed from Liv-ex www.liv-ex.com


Do you offer investment advice?

We don’t offer investment advice but we can assist you with both sourcing and selling wine and an Independent appraisal of your Collection. Contact patrick@nexuswine.com for more information.


Can you buy or sell wine for me?

We can assist with both.


What is your commission on selling/buying wine?

3-7% depending on membership tier. Pricing


Can you manage an inventory for wines that I have at home?

This service is available to Nexus Grand subscribers.


Can you ship my wines to other countries?

Post-Brexit, within Europe this has become more complicated and expensive but yes, most things are possible! Long-haul is quite straightforward. Please contact departures@nexuswine.com


What’s the difference between In Bond and Duty Paid?

The terms "in bond" and "duty paid" refer to the tax status of wine in relation to government duties.

In Bond: This refers to wine that has not yet had duty & VAT paid on it. These wines must be stored in an HMRC approved bonded warehouse, where they can be held in duty suspension until they are removed from the warehouse for sale or consumption.

Duty Paid: This means that the duty & VAT has been paid on the wine, making it ready for sale and distribution.Duty paid wines can be sold freely to retailers and consumers without any additional tax considerations.

What will the duty and VAT be if I take my wines out of Bond for delivery?

Can I come and see my wines?

We can arrange for you to visit the warehouse, please contact us with plenty of notice, ideally 10 days.


What is the benefit of storing independently?

Storing your wine through a specialist independent storage & inventory business such as Nexus guarantees that your wines are stored professionally and independently of any merchant or brokers stock. Each case is uniquely identified as being your property and fully insured at replacement market value. Fine wine has become an expensive commodity, and peace of mind is key for our members.


Why do I have to pay a receipting charge?

The receipting charge is an audit of your wine upon arrival into your Nexus account. If the wine has been delivered incorrectly or is damaged upon arrival, we will notify you.


Can I see recommended drinking dates, reviews, tasting notes and critics scores through my Nexus account?

By default we reproduce any drinking dates published by the merchant you bought the wine from. Nexus Premium members have access to recommended drinking windows, sourced from reputable critic tastings and Livex algorithms.


How do you invoice me?

We can invoice you monthly or annually with payment by direct debit.


If I’m invoiced for storage annually at the beginning of the year, what happens if I remove cases during the year?

We credit you pro-rata for the remaining full months of the year.


What’s better, annual or monthly billing?

Monthly billing is less suitable for smaller collections (there is a minimum monthly fee) but allows you to spread the cost of storage over 12 months.


What happens if NEXUS goes into administration?

Should NEXUS cease trading the management of your wines would pass to the warehouse where the wines are in-situ. All cases are uniquely identified and NEXUS has never held title so they cannot be confused with any asset of the business, ie cannot be sold by liquidators to cover any NEXUS debt. This is really important and compares favourably to leaving it with the merchant you purchased from.

At the point of liquidation you would have the option of entering into a storage arrangement with the warehouse directly, on their own terms (which would likely be higher than current terms), or withdrawing the stock. The appointed adminstrators would manage this transition as they seek to offload the cost liability on the business.

NEXUS pays storage on behalf of clients every month, so if client storage has been paid at the start of the year and NEXUS enters administration during the year, it is possible there may be an outstanding storage balance to be settled prior to release, but this would be a maximum of 11 months.

In reality NEXUS runs without debt and has made a profit every year of it's trading history so it's difficult to envision a situation where this could occur but it can be mitigated by paying storage monthly by direct debit. We will happily set this up for you on request.

Finally, the only real confidence you can have is by visiting your wine. We'd recommend this periodically - and we’re happy to arrange visits at your convenience.

Nexus Terms & Conditions

These Terms & Conditions form a contract in relation to the provision of warehousing, distribution, data and other services between NEXUS Wine Collections Ltd and the ‘Customer’being the person or company who contracts for the services of NEXUS. The registered address of NEXUS is NEXUS Wine Collections Ltd, 64 Southwark Bridge Road, London, SE1 0AS. Company Registration No: 5548347.

Provision of Information

NEXUS relies upon accurate and timely provision, by the Member or their agents, of information relating to products, receipts, despatches, orders and delivery profiles. Delivery information must include accurate postcodes and telephone numbers. All rates and charges will be reviewed annually.

Customer Instructions

NEXUS can only accept withdrawal instructions from authorised persons to pre-advised delivery addresses. Authority for additional personnel or addresses must be advised in writing.

Receipt of Goods

NEXUS will provide the customer with a Wine Receipt. It is the responsibility of the customer to ensure that the details contained within this document are correct as NEXUS is unable to accept any financial liability for the input of incorrect data.

NEXUS reserves the right to:

i) Charge part cases at the appropriate full case rate
ii) Split a case containing more than one product and charge accordingly.

Unless otherwise instructed, NEXUS will not open cases to verify the number of bottles and that the description on the bottle labels corresponds with the accompanying paperwork. If the packaging is identified as ‘non-original’, or at the customer’s request, NEXUS will open cases for a charge per case to record and verify its contents.

NEXUS does not check the authenticity of bottle labels or liquid in bottles received, nor its quality or condition.

NEXUS does not accept liability for a deterioration in the condition of the contents of the case (including liquid, labels, corks and capsules). Over time the conditions of the contents of the case may deteriorate as a result of the natural ageing process.

Storage

All stock will be securely stored and uniquely identified. Rent will be quoted and charged per month (part months will be treated as a full month). Rent is payable in advance to the end of the storage term. For clients on annual billing, credit for full unused months is given for wine withdrawn during an invoice year.

A report detailing the Customer’s stock will be produced on demand. NEXUS will undertake regular stock checks and discrepancies will be notified to the Customer. The Customer, with prior agreement, will be allowed access to the relevant facilities in order to undertake physical stock checks once each year.

Deliveries

NEXUS will always use its reasonable endeavours to adhere to agreed delivery days and specified delivery times. However NEXUS can accept no liability for missed deliveries and must reserve the right to alter delivery days and times without notice where necessary.

Driver will only deliver to the entrance of the premises and will ensure the delivery is confirmed in their presence.

The carrier used for deliveries will be at NEXUS’s discretion. The customer will be notified, as soon as reasonably practical, of any delivery discrepancies. Where NEXUS has not been at fault redeliveries will be chargeable. NEXUS will provide a scanned image of the Proof of Delivery (P.O.D.) upon request. P.O.D.s will be stored for a maximum of 12 months. NEXUS cannot guarantee the retrieval of P.O.D.s after this 12 month period and shall have no liability whatsoever for losses however caused arising from claims relating to such P.O.D.s or the non-return of.

Payment Terms

NEXUS shall be entitled to invoice the Customer as frequently as necessary, in order to maintain an equitable cash flow. Unless otherwise agreed in writing, payments must be made in full, without deduction, set off or counter claim within 15 days from date of invoice.

All charges are based on transactions of one unit, or ‘case’. Transactions of smaller quantities, i.e. bottles, may be subject to an additional charge.

NEXUS reserves the right to refuse the release of Customer stock pending receipt of cleared funds to ensure that the customer’s outstanding debt remains below the cost value of stock held.

All charges are exclusive of VAT which is payable in addition, where appropriate, as defined by relevant VAT legislation.

NEXUS reserves the right to exercise its statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if NEXUS is not paid according to the above payment terms.

Right of Lien

Sufficient stock must be held in NEXUS’s care at all times to cover all outstanding monies. In the event of failure by the customer to pay any amount due to NEXUS, NEXUS may, at the due time, without prejudice to its other rights and remedies against the Customer, give notice in writing of its intention to sell or otherwise dispose of the goods. The proceeds of the sale or disposal shall be remitted to the Customer after deduction for all expenses (including a 5% administration charge) and all amounts due to NEXUS from the Customer.

Removal of Entire Stocks

All monies due to NEXUS by the Customer must be paid and cleared in full prior to the final release of goods with sufficient reclaimable value to cover any amounts owing by the Customer and suspended duty & VAT. Removal of entire stocks terminates the contractual relationship in its entirety between the Customer and NEXUS.

Claims, Liability & Insurance

In the event of breakage or loss NEXUS will advise the value to be recompensed. Customers will, where possible, at their option, be offered a like for like replacement. In the event of value disagreement, claims for further compensation must be submitted within 28 days of notification of such damage or loss.

In no circumstances, shall NEXUS be liable for fraudulent activities of the Customer, their representatives or agents or liable for any loss (whether direct or indirect) of profits, goodwill or business opportunity or for any indirect, special or consequential loss.

NEXUS shall not be responsible for the any act or omission or delay or non-performance of any of its obligations caused by events beyond NEXUS’s power or control.

NEXUS agree to purchase extended insurance coverage for its liability for Customer’s goods whilst in its custody or control for ‘All Risks’ of accidental physical loss and or damage. Specifically excluded (inter alia) from this insurance are loss and or damage and or expenses:

i) attributable to wilful misconduct of, or any act of dishonesty committed or connived at by, the customer or any associate thereof;
ii) to mixed cases where contents have not been checked beforehand
iii) cause by depreciation other than as a result of damage forming the subject of a valid claim hereunder
iv) caused by inherent defect, wear and tear, nature of the subject-matter insured, gradual deterioration, atmospheric or climatic conditions;
v) directly or indirectly caused or contributed to or by arising from:
a. ionising radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel, or
b. the radioactive, toxic, explosive or hazardous properties of any explosive nuclear assembly, nuclear component or radioactive material;
vi) which is a consequence of war, invasion, act of foreign enemy, hostilities (whether war is declared or not). Civil war, revolution, rebellion, insurrection, military or usurped power, or civil strife arising therefrom, or any hostile act by or against a belligerent power;
vii) caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotion;
viii) which is due to confiscation, requisition, detention or destruction by or by order of any government, public or local authority;
ix) due to a lack of or a defect in the title of the Customer or any past, present or future owner or purported owner;
x) directly or indirectly caused by any terrorist, terrorism, or any person acting from a political motive;

NEXUS’s liability shall be limited to the replacement value or market value of the goods, whichever shall be the lower.

‘All Risks’ cover is conditional upon the Customer not breaching NEXUS’s payment terms. In the event of a breach of NEXUS’s payment terms ‘All Risks’ cover will automatically cease without any notice to the customer.

Confidentiality

All information disclosed by the Customer or NEXUS is confidential, and shall not be disclosed by either party, other than to employees, agents or sub-contractors of each, who reasonably require to know such information for the performance of their duties. This clause does not apply to information already in the public domain, or which comes into the public domain (other than through a breach of this clause) or information which the party is required by Law to disclose. Effectiveness of Terms & Conditions

These Terms & Conditions take effect from 1st Jan 2023 and supersede all previous versions that are now null and void.

Receipt of stock into a NEXUS cellar is classed as acceptance of these Terms & Conditions by the Customer, unless otherwise agreed in writing.
